Privacy notice

What we collect when you plan an outing with us, what we use it for, who we share it with and how you control it.

Last updated: October 29, 2026

Who is responsible

Sunset Society is a brand operated by ALMENAR, S.A.S., based in Puerto Vallarta, Jalisco, Mexico. ALMENAR, S.A.S. is responsible for your personal data under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations and the Privacy Notice Guidelines.

For anything related to your data, write to our concierge. It is the same channel for questions, bookings and privacy requests:

What data we receive

  • When you build a quote on the site: the experience, the date, the number of adults and children and the hours. This does not identify you.
  • When you write to us on WhatsApp: your name and number, the conversation and what you tell us to organize the outing (date, group size, ages of children on board, the occasion, preferences).
  • When you book: the name and contact of the person booking, the date, the number of guests and the payment receipt; if you ask for an invoice, your tax details.
  • If you join the Society: your name, your contact, the outings where your arrival was recorded and your points balance.
  • If you use “Send feedback”: the type of comment, the text you write, the page you were on and, only if you tick the box, your email so we can reply.
  • Like any website, the server keeps a technical log of each visit (IP address, date and time, page and browser). It is used only to protect the site and is deleted after 3 days. If a page fails in your browser, we receive the type of error and the file, never your data.

Sensitive data and minors

We do not ask for sensitive data. If you tell us about a health condition, an allergy or a mobility need so your outing is safe, we use it only for that and share it only with the operator and crew of your outing. By sending it, you give us your express consent for that use.

We do not collect data directly from minors. The adult who books tells us how many children are going and their ages, which the crew needs for safety on board.

What we use it for

To provide the service you ask for (primary purposes):

  • Answer your quote and check availability with the operator.
  • Book and confirm your outing, and coordinate the dock, the time, the weather and any change.
  • Process payments, issue invoices and handle refunds.
  • Manage your Society points and the courtesies of allied restaurants.
  • Answer your questions, comments and complaints.
  • Protect the site and comply with our legal obligations.

Additional purpose, which you can refuse: sending you news, special departures and offers from Sunset Society by WhatsApp or email.

To refuse it, tell the concierge at any time; just write “I don’t want promotions”. Refusing does not affect your booking or your points.

Who we share it with

We do not sell your data. We only share it when it is needed for what you ask for:

  • Allied operators (the boat, the captain, the tour): name, contact, date, group size and what is needed for safety on board, to provide your outing.
  • Allied restaurants: your name and booking reference, only when you use a courtesy.
  • Allied property developers: your contact and points balance, only if you ask to apply your points to a property.
  • Authorities: when the law requires it.

These transfers are needed to provide the service you request or are required by law, so they do not need your additional consent. The transfer to a developer happens only at your request.

We also rely on our technology providers (the booking platform, hosting, backups and email), which keep your information on our behalf, under contract and only for these purposes. Their servers may be outside Mexico.

WhatsApp is a third-party service with its own privacy notice: what you write there is also handled by that service.

Retention, security and deletion

  • We keep backups for up to 3 months: 7 daily, 4 weekly and 3 monthly.
  • Bank details and the files of promoters and partners are stored encrypted with a key unique to each person.
  • When someone cancels, that key is destroyed, and the copies in backups become unreadable within 7 days at most.
  • What the law requires us to keep (tax receipts, commissions paid and signed contracts) stays for 5 years, as Mexico’s Federal Tax Code requires, and is then deleted.
  • Passwords are stored with a one-way algorithm: nobody, not even us, can read them.
  • Everything travels over HTTPS.

Your ARCO rights

You have the right to access your data, rectify it if it is wrong, cancel it when it is no longer needed and object to its use for specific purposes.

To exercise them, write to privacidad@sunsetsociety.mx (or to the concierge on WhatsApp) with: your name and a way to reply, which right you are exercising and on which data, and anything that helps us find them. We will ask you to prove your identity (or your representative’s) with an official ID and tell you how to send it securely.

WhatsApp +52 322 149 6356

We answer within 20 business days and, if your request is granted, we apply it within the following 15 business days. It is free; you would only pay shipping or copies if you ask for them.

Cancellation may not apply to data the law requires us to keep, such as the invoice of a paid booking; if so, we will tell you why.

Withdraw your consent or limit use

You can withdraw your consent or ask us to limit the use or disclosure of your data through the same channel and with the same steps. We will add you to our own list of people who do not want promotions.

Withdrawing your consent cannot undo what was already done, and we may need to keep some data to finish a booking in progress or to comply with the law.

You can also sign up for PROFECO’s Public Registry to Avoid Advertising (REPEP) to stop promotional calls and messages.

Changes to this notice

We will publish any change on this page with its new date. If a change substantially affects how we handle your data, we will let you know by WhatsApp or email before applying it, if we have your contact.

If you believe your right to data protection has been violated, you can go to the federal authority for the protection of personal data.
