Terms and conditions

The rules for planning, booking and enjoying an outing with Sunset Society, written plainly.

Last updated: October 29, 2026

Who we are and what we do

Sunset Society is a brand operated by ALMENAR, S.A.S., based in Puerto Vallarta, Jalisco, Mexico. By using this site or booking with us, you accept these terms.

We are a concierge and intermediary: we help you choose, quote and book private sunsets, charters, tours and experiences on the bay. The nautical service itself is provided by allied operators, who own or run the boats and have their own crew, permits and insurance.

The boat cards show each operator’s public rate and the information the operator publishes. The boat assigned to you is the one confirmed to you in writing.

How you book and how it is confirmed

  • Build your selection on the site (experience, date, guests, hours) and send it to the concierge on WhatsApp with the message already written.
  • The concierge checks availability with the operator and sends you the final price, the boat, the dock, the time and the conditions.
  • Your booking is confirmed only when you receive that written confirmation and, where applicable, the payment receipt. Nothing on the site, including the calendar, is a confirmed booking by itself.

Today the site does not take payments online. When confirming, the concierge tells you how to pay and gives you a receipt.

When online booking opens, it will place a hold on your card that is charged only once the boat is confirmed free for your date. We will update these terms before opening it.

Prices, taxes and separate charges

  • Prices are in Mexican pesos (MXN) and include VAT and applicable taxes.
  • A “from” price is the starting price: the final price depends on the boat, the hours, the number of guests, the date and the extras you choose.
  • Each marina charges its own dock fee per person, paid on arrival at the dock. We tell you the amount for your boat before you confirm.
  • Tours use the public rate of each operator; children’s rates and dock taxes are shown separately.
  • Before you pay, you receive the total broken down, including any charge that is paid separately.

Cancellations, changes and refunds

  • If you cancel 72 hours or more before departure: full refund.
  • Between 72 and 24 hours before: a 50% refund, or one change of date at no cost, subject to availability.
  • Less than 24 hours before, or if you do not show up: no refund.
  • If the operator cancels (a mechanical failure or any cause of its own): a full refund or a new date, whichever you choose.
  • If you arrive late, the outing may leave or be shortened to keep its schedule; the time lost is not refunded.
  • Refunds are made to the same payment method within 10 business days after the cancellation is confirmed; your bank may take a few more days to show it.

To cancel or change, write to the concierge on WhatsApp. The time of your message counts.

Weather

  • If the Port Authority closes the port, or the captain decides conditions are not safe, your outing is moved to another date at no cost or refunded in full, whichever you choose.
  • If an outing has to return early for safety, we refund the part of the time not sailed.
  • Clouds or light rain do not cancel an outing by themselves. A clear sunset and the green flash are never guaranteed.

On board: children, alcohol and safety

  • The captain is the authority on board. His or her instructions are mandatory, and the captain may refuse boarding or end the outing if someone puts the group, the crew or the boat at risk; in that case there is no refund.
  • Minors always sail with a responsible adult, who looks after them during the whole outing. Children count toward the boat’s capacity, and life jackets in their size are available.
  • Alcohol is served only to people 18 and over. The crew may stop serving anyone who has had too much. Illegal drugs are not allowed on board.
  • Swimming and snorkeling only when and where the captain allows. Whoever has been drinking does not get in the water.
  • The maximum capacity of each boat cannot be exceeded, and life jackets are worn whenever the crew asks.
  • In protected areas and during whale season, the rules of the authorities apply, including distances to the animals.

What each party answers for

  • The operator answers for providing the outing: the boat, its crew, its permits and insurance, and safety during the activity.
  • Sunset Society answers for the information on this site, for managing your booking and passing your details correctly to the operator, for handling your questions and complaints, and for processing refunds under these terms. If you have a problem with an operator, we help you resolve it.
  • You answer for giving true details, arriving on time, following the captain’s instructions and for any damage you or your guests cause to the boat or its equipment.
  • No party answers for acts of God or force majeure. Nothing in these terms limits the rights the Federal Consumer Protection Law gives you.

The Society points programme

  • Each outing with Sunset Society earns points, credited only when your arrival at the outing is recorded.
  • Points are used only toward the down payment on a property in the allied developments published on this site, with the limits per transaction that each development sets.
  • Points expire 24 months after being credited; we let you know 30 days before.
  • Points do not pay for bookings, have no cash value, cannot be exchanged for money and are personal and non-transferable.
  • The Society is not a paid membership and gives no right to use or stay in any property. The purchase of a property is governed by your contract with the developer.
  • We may change or end the programme with 30 days’ notice; points already credited keep their validity until they expire.

Allied restaurants

Allied restaurants may offer a courtesy to those who sail with us. Each courtesy is offered by the restaurant, under the conditions shown on its card; it has no cash value and cannot be combined with other offers unless the restaurant says so.
